Safe Travels this Holiday


The Holidays are in full swing and with Christmas just a day away; many have already started their Holiday travels. Being the insurance people that we are, here are a few tips for a safe and secure season of travel.

1) Make your home seem like someone is still there. You can do this several ways. Leave your front and back porch lights on so that at night your house is lit up. Ask a neighbor to collect your mail while you are gone so it doesn’t stack up. You can also ask the post office to hold if for you until you get back. Another way to make it look like you are home is to ask a neighbor to pull in and out of your driveway at some point if it snows giving the appearance that you have been in and out of your house.

2) Don’t show off to the Facebook world that you are on vacation. I know this can be tough for some but letting everyone know you are out of town on Facebook can be dangerous. We recommend waiting until you get home from your trip before you post vacation pictures.

3) Car travelers should be prepared for heavy snow at all times. The best way to do this is to make sure you have extra blankest, windshield washer fluid, ice scrapers and even a small shovel. You never know when you might need any of those things. Also, be sure to have your phone charged during the trip so that you have it in case of an emergency.
4) Don’t skimp on heat in your home: we recommend to keep the heat in your house at a reasonable level so your pipes don’t freeze.

On a daily basis you see ads on TV for home security systems. We at Fey Insurance highly recommend the installation of a Home Security System to add additional protection for you and your family. WHY AN INSURANCE COMPANY WILL NOT PAY YOUR CLAIM


This blog was a lecture I was to deliver at a Workshop in Lagos.

INTRODUCTION

I sincerely wish to thank the organizers of today’s workshop for the opportunity to speak to you and also for thinking it important that among the issues to be treated in today’s event is a topic on insurance.

I particularly and deliberately chose this topic in order to educate, enlighten, inform and change your opinion about “Insurance.” In my number of years in the insurance industry, I have come to realize the attitude of Nigerians to insurance which is a negative one. During a recent study it was discovered that about 800 Adults in Nigeria have insurance (NEPAD), which leaves about huge gap of the population to be uninsured. Also recently a research showed that the insurance industry in Kenya is bigger than the one in Nigeria. Why these poor statistic? The reason is obvious Nigerians don’t like insurance or avoid it like a plague!

I have observed over the years in my talking with people about Insurance that their responses mostly is always the same- “Insurance companies in Nigeria don’t pay claims!” People believe this statement and have become like a cliché and have been passed around from generation to generation. That is why this topic is very vital, it is meant to clear the air and change your mentality about Insurance. 

Ladies and Gentlemen follow me on a journey to discover the reasons why claims are not paid.

After the independence 3 out of 25 insurance companies operating in Nigeria were indigenous. Political independence and the spirit of nationalism led to developments and also the proliferation of insurance companies which was facilitated by the weak conditions set by the 1961 Insurance Companies Act which stipulated a Capital requirement of only 25,000 pounds. The legislation was exploited by investors who established companies – mushroom insurance companies which were too weak to compete with the then expatriate-owned outfits. During these period and afterwards many claims were recorded that were not paid hence people came to the conclusion that insurance expert are more like fraudsters or cheats who take your money and will not pay your claim when you sustain one. This paper is written to correct this notion and hopefully clear all doubts.

However, the good news now is that as time goes on legislation and regulators emerged that changed the state of affairs in the insurance in the country. It should be noted that it is no longer business as usual in the industry. NAICOM oversees the affairs of all players in the industry and is ready to listen the report of any aggrieved member of the public. For the broker, NCRIB and for the Insurance Company it is the NIA and there is a joint body that oversees all report in respect of any industry player, and if all these avenues fail NAICOM will be the last resort.

Before I proceed further, I would like to briefly define the following terms:

Insurance: an insurance contract is an agreement enforceable at law between an insurer and an insured; the insured agreeing to pay a premium and the insurer agreeing to pay a sum of money, or something of monetary value, on the happening of a specified event to the insured.

Insurance Company: an insurance company also called the insurer, is a company that carry-out insurance services.

Insured: an insured is a person who purchases an insurance policy, also called a Policy Holder.

Claims: Claims and loss handling is the materialized utility of insurance; it is the actual "product" paid for. Claims may be filed by insureds directly with the insurer or through brokers or agents. 

Now let us attempt to delve into the reasons Why an Insurance Company will fail to pay a claim. I am going to speak plainly in this paper and would at all cost avoid technical jargon for the sake of clarity.  There are many reasons why an insurance company would not pay a claim but for want of time, only 5 reasons would be considered, viz:

1.         Unpaid/Un-remitted premium
2.         Fraudulent Claim
3.         Incomplete Documentation
4.         Insurable Interest Issues
5.         Fake Insurance Cover

Unpaid / Un-remitted Premium: according to the Principles of Insurance which is also true when it comes to the Principle of Contracts, premium (which is consideration in the Law of Contract) must be paid in advance for the contract of insurance to be valid. This is the most important aspect of an insurance cover, without which there is no cover – NO PREMIUM, NO COVER! At times agents, after taking up a policy on someone’s behalf might fail to remit the premium to the insurance company before a loss. However, when such a loss thus occurs, the first thing an insurance company will check is the premium status of the policy. If the premium had been settled before the claim, the claim stands a high chance of being paid in full, all things being equal. However, if the premium was not paid before the loss, repudiation (rejection or refusal) is the remedy. You may ask: How do I avoid this? I’ll tell you. To avoid finding yourself in this kind of embarrassing situation, pay your premium immediately you purchase the policy or pay a deposit premium instantly (in case of part-payment)  and followed by the balance payment immediately. Not only that, if you purchase the policy through an agent then be deliberate, issue your premium cheque in the name of the insurance company on your insurance paper and not the agent’s name.

Fraudulent Claim: insurance is taken for an unforeseeable occurrence i.e. the event, occurrence, loss or outcome must be probable (under probability). If a person, for instance purchase a fire insurance and decides to set his house on fire, it's a criminal act called arson! Or willfully damage his car (in the case of motor insurance) in order to come for a claim - it is fraud! When an insurance company is able to trace a claim to fraud, the claim will be repudiated automatically. I recall a case few years back with one of our clients. This man reported that his car was engulfed in flames from his engine while in motion, which according to him resulted in the total loss of the vehicle on the highway. After documentation the office sent me out to inspect the burnt vehicle at the point he said it was burnt. Armed with my camera, I set out on what eventually turned out to be a wild goose chase. What happened was that, after combing the area alleged to be the spot of the accident without success, I decided to ask some policemen in that area. Surprisingly, they told me that no such accident occurred in that area at the said date and time. Conclusion was that there was no such accident and the insured had reported a fraudulent claim which led to the claim being repudiated.

Incomplete Documentation: if you are filling in a claim be ready to turn in all documents. For example, proof of ownership, photographs, purchase receipt/invoice, estimate of repairs etc in the case of motor insurance claim. And in the case of personal accident claim medical report, receipt of payments etc are necessary. I dealt with this subject in my blog: Documents needed that will make your claims valid. Check out my blog page for that. Make sure your documents are in order and complete without that your claim will be delayed unnecessarily because insurance is based on documentary evidence. So take my advice, tender every document as evidence, be patient. Another client of mine reporting a Workmen’s Compensation Claim was told to supply the medical report, receipts and every other document to show that one of his staff was actually involved in the accident. What he sent was just a picture of the victim on a hospital bed, when we ask for the other documents he became furious and said it was rubbish! Till date the claim is still pending, if he decides to tender the documents the claim will be treated further. So document as if
your life depended on it.

Insurable Interest Issues: Insurable interest is one of the elements necessary to create a valid insurance contract. Insurable interest may be simply defined as the legal right to insure arising out a financial relationship recognized at law, between the insured and the subject-matter of insurance. To have insurable interest in a contract of insurance, the insured must have a pecuniary interest in the subject matter of insurance, which is recognized at law to enable him take an insurance contract on that subject matter of insurance. So it means before one can insured an item or property there must be legal right to do so, i.e. there must either be property right, interest of life, limb or potential liability etc. Now if one does not have right to insure a property, even if he does and at the eventual loss of that property the insurance company now discover that the insured had no interest in the property the claim would be repudiated. The premise here is you cannot insure what you don’t own or have legal right to possess.

Fake Insurance: In Nigeria 80% of the Third Party Certificate people use are fake! It is shocking to note this, but it is true, some people who portray themselves as Insurance Agents are not, they just take people’s money and give them empty paper in the name of Certificates. Do you know that your Third Party Motor certificate actually covers you to the sum of N1,000,000 in property damage to a Third Party and also an Unlimited amount to the Death or Bodily Injury of a Third Party? If you did not know, now you know! 

So buying fake insurance, you are actually short changing yourself, because it is so cheap that you pay N5,000 to get the cover and funny enough a fake insurance cost like N3000 or less to cover nothing! Why not just buy the real thing and get a real cover than the fake one without a cover. Which would you rather buy, fake or real? 

I recall a young man how purchased from my former company a Third Party Cover for his truck and paid N10,000 and as events will have it, he had an accident with  his truck somewhere in Mile 2 and killed a pedestrian. He was charged to court and have to pay like N500,000! He came to the company to claim and it was discovered that everything was in order, he was settled in full. Note that he paid N10,000 and was able to claim N500,000, that’s insurance for you!

In the light of that, I also recall when I was still in an Insurance Company (name withheld) there was this man who rushed to us with a claim and our Motor Certificate, but after receiving the document from him we observed that the certificate was a fake one, it was probably issued by the peddlers of fake insurances, his claim was turned down. The question now is how do you avoid this? My answer is approach the right person – that is where a broker or experts come in or even go to the insurance company directly. 

Instead of bothering your head with all the technical jargon in insurance, just leave it to us as professionals and they will handle it for you. Do you know the good news? You are not paying extra for the services, just your premium.


CONCLUSION

Insurance is a legitimate business and also legal profession therefore should not be taken for granted or with levity. It requires utmost seriousness just like law, medicine and others. Insurance is not a dubious business, it is for your safety and peace of mind. It relieves you of the anxiety of preparing when a risk occurs. Alternate Sources of Home Heating


The high cost of home heating and the current recession have led many Americans to search for alternate sources of home heating.  Many of these sources of heating may be acceptable if appropriate safeguards are used.  However, be aware these supplemental heating devices are responsible for thousands of home fires each year.

WOOD STOVES
Wood stoves cause more than 4,000 residential fires each year.  Carefully follow the manufacturer's installation and maintenance instructions.  Look for solid construction, such as plate steel or cast iron metal.  Check for cracks and inspect legs, hinges and door seals for smooth joints and seams.  Use only seasoned wood for fuel, not green wood, artificial logs or trash.  Inspect and clean your pipes and chimneys annually and check monthly for damage or obstructions.  Cleaning more often may be necessary.  Be sure to keep combustible objects at least three feet away from your wood stove.

ELECTRIC SPACE HEATERS
Buy only heaters with the Underwriter's Laboratory (UL) safety listing.  Check to make sure it has a thermostat control mechanism, and will switch off automatically if the heater falls over.  Space heaters need space, keep combustibles at least three feet away from the heater.  Always unplug your electric space heater when not in use.

KEROSENE HEATERS
Buy only UL-approved heaters and check with your local fire department on the legality of kerosene heaters use in your community.  Never fill your heaters with gasoline or cam stove fuel, both flare up easily.  Only use crystal clear K-1 kerosene.  Never overfill an portable heater and never fuel the heater when it is hot.  Use the kerosene heaters in a well-ventilated room.  Kerosene heaters pose perhaps the worst exposure largely due to improper use and the fact they contain a highly flammable liquid-not to mention potentially dangerous fumes.

FIREPLACES
Fireplaces and wood stoves regularly build up creosote in their chimneys.  They need to be cleaned frequently and chimneys should be inspected for obstructions and crack to prevent deadly chimney and roof fires.  Check to make sure the damper is open before starting any fire.  Never burn trash, paper or green wood in your fireplace.  These materials cause heavy creosote buildup and are difficult to control.  Use a screen heavy enough to stop rolling logs, and big enough to cover the entire opening of the fireplace to catch flying sparks.  Do not wear loose fitting clothes near any sealed metal container outside the home.

Finally, having a working smoke alarm dramatically increases your chances of surviving a fire. Always remember to practice a home escape plan frequently with your family.

Insurance Things to Consider on Rental Properties


Over the last few years many homeowners have turned into landlords.  With the real estate market drop, those that decided to purchase a new house also decided to not sell their prior home for fear of a financial loss on the property.  Instead, they have turned their prior house into a rental.  The trend still continues today even after the real estate market has rebounded some because landlords are seeing great cash flows from renting.  

Here at Fey Insurance Services we insure a number of these properties and on occasion we are asked by clients if we have any insurance tips in renting a property.  When asked we always mention these five things:

1.  Temperature Requirement in the Lease:  It is a good idea to include a clause in your lease that requires the tenant to keep the heat no colder than 59 degrees.  This is important because around the Holidays many tenants will travel and if they want to try and save a buck they may turn off the heat.  Pipes do not enjoy this especially with a polar vortex threatening again this year.  This way, if they do turn the heat off and pipes break you can pass that damage on to the tenant.

2.  Renters Insurance for Tenants:  Since you may have passed on the risk of pipe freezing damage to your tenant you then want to make sure they have insurance in place to pay for such damages.  Requiring tenants to have renters insurance is a good idea.  Not only does it protect their contents (which is excluded under your policy), it protects your property if they are negligent in causing damage to your property.  I would recommend they have liability limits at least the value of your property.

3.  Dogs:  Know your states laws on dog attacks.  For example, in Kentucky there was a law recently passed that could drag landlords into dog attack claims.  This may make it difficult to get insurance for a property that has a dog.  If you are going to allow dogs to live on your premises it is best to limit which kinds as some insurance policies exclude coverage for "vicious dogs".

4.  Loss of Rents Coverage.  Make sure your rental property insurance policy includes coverage for loss of rents.  If you sign a year's lease with someone and then have a fire a month later, you are going to be out 11 months of rent or at least however many months it takes to rebuild the house.  You can recoup this loss with loss of rent coverage.  Also, make sure that you have enough loss of rent coverage.  Many polices give  you 10% of your dwelling limit or give you a flat $25,000.  Add up your annual rents and make sure you have enough coverage.

5.  Certificates of Insurance from Contractors:  Unless you yourself are handy, you may be employing contractors to do fixes around your rental property.  We strongly recommend you ask these contractors for proof that they have insurance.  If they were ever to cause damage to your tenants contents or to your tenants person, you would want to make sure they have insurance to cover such things.

So I Sent My Child Off to Daycare....

My daughter turned one in June.  We knew we were going to have to transition her from having Aunty watch her nearly every day to a traditional daycare setting soon.  Panic ensued.  Anxiety was my friend at night. How was my daughter going to be OK if she couldn't even talk to me and tell me how her day went?

Let's talk childcare insurance.  You see, I come from a different perspective.  I come from a side where I see the most horrific claims come through as one of my specialties is in the childcare insurance industry. 

It's pretty astounding to me that some, not all, but some childcare owners are ignorant in that claim scenarios "would never happen at their daycare".  I hear "Our staff is extremely professional and well trained.  Something like that would never happen here."  Fortunately, they're usually right.  But it's not necessarily the staff, parents or visitors that the school or daycare needs to look out for.  It's other children. 

I would say, and this is a rough estimate so don't quote me on this, that approximately 50% of the claims I have seen aren't teacher, instructor or caregiver driven.  It's child vs. child.  Whether that is a hit, a slap, a push or something more inappropriate, children who can't properly express their emotions through words, sometimes turn to violence out of frustration.  I see little bouts of this every day in my daughter.  She tries to communicate with us what she would like.  She points at things, gives us signs.  But at times, we have no idea what she is trying to tell us.  She gets frustrated...and understandably so. 

It turns out that we found an excellent daycare that's right for my daughter and our family.  But, when I did visit other daycares, I not only paid attention to the facility, the employees, the surroundings, but to the other children that were attending.  My daughter would be attending this facility every day with this group of children.  And I needed to feel comfortable with that.

Now I could go on and on about the different types of insurance that is needed for childcare organizations, but here are a few that I believe are overlooked but pertinent to schools, daycare centers and childcare organizations of any kind:
  • Failure to Educate - especially here in Silicon Valley, we've seen a major uptick in failure to education claims coming from Pre-K or Kindergarten school settings.  Facilities that make any sort of promise of "curriculum" or learning ability are under fire.  Make sure a failure to educate limit is included in your insurance.
  • Incidental Medical Malpractice - this affords coverage for an act, error or omission in providing or failing to provide "incidental medical services", first aid or "good Samaritan" services to a person.  Think of school nurses who accidentally mix up Tylenol and Benadryl or even worse, another child's medication.  Enough said.
  • Defense Wording - Some insurance carriers have the right not to defend an accusation or claim.  It's important to have a carrier that has defense wording language that will continue to defend the organization until guilt is admitted or a guilty verdict is determined. 
  • Abuse and Molestation - This is a touchy topic and an obvious one.  Many insurance carriers do not provide a separate limit for A&M.  They include a sub-limit for this coverage and it depletes your overall insurance limit for the year.  Find a carrier that will give you a stand alone limit for A&M.  They don't happen often.  But when they do, they are very, very large.  Your organization will need the separate limit.  Trust me.

    Auto Insurance Basics

    Auto insurance is a contract that protects your financial security in case of an accident. Although it is not mandated by federal law, the purchase of auto insurance is usually a requirement in most states; every state (with the exception of New Hampshire and Wisconsin) have minimum insurance laws.

    These two states, instead of having insurance requirements, have mandated financial responsibility laws, so that the owner of a car is required to show that he has sufficient funds to pay any necessary claims. If said owner cannot produce proof of satisfactory assets, then he must buy an auto insurance policy. Regardless of the law, having good auto insurance is practical for the driver who wishes to avoid lawsuits or immense repair bills.

    According to the Insurance Information Institute (III), a basic auto insurance policy is comprised of six basic types of coverage. While some of these types of coverage are required by state law, some are considered optional.

    These are: 1. Bodily injury liability 2. Property damage liability 3. Medical payments or Personal Injury Protection (PIP) 4. Collision 5. Comprehensive 6. Uninsured/Underinsured motorists coverage

    Liability Insurance

    Liability coverage is the foundation of any car insurance policy, and is required in most states. If you are at fault in an accident, your liability insurance will pay for the bodily injury and property damage expenses caused to others in the accident, including your legal bills. Bodily-injury coverage pays for medical bills and lost wages.

    Property-damage coverage pays for the repair or replacement of things you wrecked other than your own car. The other party may also decide to sue you to collect "pain and suffering" damages.

    Liability insurance (both bodily injury and property damage) is the foundation of most auto insurance policies and is ideal if you are seeking a low cost car insurance policy. Every state that requires auto insurance mandates the purchase of property damage liability, and Florida is the only state that requires auto insurance but does not call for bodily injury liability. If you are at fault in an auto accident, your liability coverage will pay all the expenses, bodily injury, property damage, and any legal bills. The bodily injury coverage would pay for medical bills and lost wages; the property damage coverage would pay for any auto repairs, or replacement. Property damage liability usually repairs damage to other vehicles, but can also cover damages to things such as lamp poles, fences, buildings, or anything else that your car may have struck.

    Remember, although purchasing only the minimum can get you a cheap auto insurance rate, if you cause a serious accident, minimum insurance may not cover you adequately. That's why it's a good idea to buy more than what your state requires. If you own a home and have nest egg and a savings account, you should consider more liability insurance because, in most states, drivers are allowed to sue other drivers who injure them in car accidents. If you're sued and your liability insurance doesn't pay for all of the damages, your personal finances are on the hook, and it's likely you'll become a target.

    Collision and Comprehensive Coverages

    If you cause an accident, collision coverage will pay to repair your vehicle. You usually can't collect any more than the actual cash value of your car, which is not the same as the car's replacement cost. Collision coverage is normally the most expensive component of your car insurance rate. By choosing a higher deductible, say $500 or $1,000, you can keep your premium costs down. However, keep in mind that you must pay the amount of your deductible before the insurance company kicks in any money after an accident.

    Insurance companies often will "total" your car if the repair costs exceed a certain percentage of the car's worth. The critical damage point varies from company to company, from 55 percent to 90 percent.

    Comprehensive coverage will pay for damages to your car that weren't caused by an auto accident: Damages from theft, fire, vandalism, natural disasters, or hitting a deer all qualify. Comprehensive coverage also comes with a deductible and your insurer will only pay as much as the car was worth when it got wrecked.

    Because insurance companies normally will not pay you more than your car's book value, it's helpful if you have a rough idea of this amount. Check the Kelley Blue Book or the National Automobile Dealers Association. If your car is worth less than what you're paying for the coverage, you're better off not having it.

    Neither collision nor comprehension insurance is required by any of the states, but some lenders, when the owner finances the car, may require the purchase of collision and comprehensive in the loan agreement. Even when it is not required, collision and comprehensive coverage is highly recommended by the insurance industry, so that in the unforeseen event of damage or theft, the owner of the car can avoid heavy bills. Theft of cars is not as unusual as some people may think. In 2004, a car was stolen in the United States every 26 seconds, and a car had a 1 in 190 chance of being stolen.

    Medical Payments, PIP, and No-fault coverages

    Medical payments (MedPay) coverage will pay for your and your passengers' medical expenses after an accident. These expenses can arise from accidents while you're driving your car, someone else's car (with their permission), and injuries you or your family members incur when you're pedestrians. The coverage will pay regardless of who is at fault, but if someone else is liable, your insurer may seek to recoup the expenses from him or her.

    Personal Injury Protection (PIP) coverage is an extended form of MedPay. PIP may cover expenses that are related to injury, but not necessarily medical, such as lost wages, childcare and funeral costs. PIP coverage is currently required by sixteen states. If you are already insured under a good health insurance policy, then fortunately, there is no need to buy more than the minimum required amount of PIP or MedPay insurance.

    If you have a good health insurance plan, there might be little need to buy more than the minimum required PIP or MedPay coverages, if at all. And, if you already have disability insurance, there's little reason to purchase higher-than-minimum amounts of PIP.

    Uninsured/Underinsured Motorists Coverages

    Uninsured motorists (UM) coverage pays for your injuries if you're struck by a hit-and-run driver or someone who doesn't have auto insurance. It is required in many states.

    Underinsured motorists (UIM) coverage will pay out if the driver who hit you causes more damage than his or her liability coverage can cover. In some states, UM or UIM coverage will also pay for property damages. Similarly, underinsured motorists insurance will cover any damage caused when you are struck by a driver who is not insured for a sufficient amount.

    If you are hit, as a pedestrian, underinsured coverage will cover the expenses. Uninsured motorists insurance is currently required by twenty states, and Underinsured motorists coverage is required by only four: Connecticut, Minnesota, Maine, and Vermont.

    You'll probably want to have at least the minimal amount of UM/UIM because if you can't find the other driver, you'll at least have some coverage for pain-and-suffering damages.

    Add-on Features

    Several supplemental auto coverages are available, either as separate premium items or included in augmented policies. -Rental reimbursement, a common add-on, covers vehicle rentals required because your car is damaged or stolen. -Coverage for towing and labor charges in case of a road breakdown is also common. -Gap coverage for your new car will pay the difference between the actual cash value you receive for the car and the amount left on your car loan if your vehicle is totaled in an accident.

    Basic auto insurance is required by virtually every state and is typically the cheapest auto insurance in the marketplace. Proof of insurance is required at different times throughout the life of a vehicle.

    You may be asked for proof of insurance at any and all of these times: at vehicle registration, at the time of an accident, and any time when driving the vehicle. It is suggested that the owner of the car keeps proof of insurance in the car at all times, instead of on his or her person, so that it can be available at all times, no matter who is driving.

    Any violations of state law regarding auto insurance could result in, at best, a hefty fine, and at worst, suspension of your driver's license and/or time in jail. The dire consequences of driving while uninsured are not worth the neglect of paying for insurance. The chance that an uninsured driver will avoid detection is slim; he is likely to be caught and strictly punished.
